These Terms and Conditions (“Terms”) govern your use of our website (omnivexco.com) and our services, including Axiom, Yabble, Konekt, Inspi, and any related applications or platforms (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Eligibility

You must be at least 13 years old to use our Services. By using our Services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. User Accounts

Some Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate and complete information when creating an account and to notify us immediately of any unauthorized use of your account.

4. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Services to violate any applicable laws or regulations.

You represent that you have the right to submit User Content and that it does not violate any third-party rights or applicable laws.

Some Services may require payment or subscriptions. All fees are non-refundable unless otherwise stated. You agree to provide accurate payment information and authorize us to charge your payment method for all fees due. We may update pricing at any time, with notice provided via our website or email.

8. Termination

We may suspend or terminate your access to the Services at our discretion, including for violation of these Terms or non-payment of fees. You may terminate your account at any time by contacting us. Upon termination, your right to use the Services will cease, but provisions such as Intellectual Property and Limitation of Liability will survive.

Additionally, if an account on any Services provided by Omnivex, LLC is found to be inactive for more than 50 days, it will be prone to being either:

  • Labeled as inactive, which is more likely if the email is valid and not a temporary email (such as Apple Private Relay emails).
  • Deleted entirely from the database, which is of higher probability if the email is temporary.

9. Limitation of Liability

To the fullest extent permitted by law, Omnivex shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including loss of data, profits, or business opportunities. Our total liability shall not exceed the amount you paid us in the preceding 12 months.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
